Section 310.41a - Doing business with unlicensed persons(a) Violation.--Any insurance entity or licensee accepting applications or orders for insurance from any person or securing any insurance business that was sold, solicited or negotiated by any person acting without an insurance producer license shall be subject to civil penalty of no more than $5,000 per violation in accordance with this act. This section shall not prohibit an insurer from accepting an insurance application directly from a consumer or prohibit the payment or receipt of referral fees in accordance with this act.(b) Penalty.--A person that violates this section commits a misdemeanor of the third degree.1921, May 17, P.L. 789, art.
