§ 2233. Establishment

A Board of Examiners of Interior Designer-Decorators is hereby created, attached to the Division of Board of Examiners of the Department of State, composed of five (5) members. Besides the other requirements established in § 2235 of this title, each member of the Board must have a good reputation, hold an interior designer or decorator’s diploma, and practice the profession in Puerto Rico. No member of the Board shall interfere with the regulated activity, through his/her position in any way that directly or indirectly monopolizes the activities of the profession.

The members of the Board shall be appointed by [the] Governor of Puerto Rico with the advice and consent of the Senate of Puerto Rico.

Initially, the members of the Board shall be appointed as follows: one (1) member for the term of one (1) year; two (2) for a term of two (2) years; one (1) for a term of three (3) years; and one (1) for the term of four (4) years. Upon the expiration of such initial terms, appointments shall be made for four (4) -year terms.

No member of the Board shall be appointed for more than two (2) consecutive terms.

The Governor shall designate the Chairperson of the Board. The Board members shall hold office until their successors have been appointed and take office.

Appointments to fill vacancies occurring for reasons other than the expiration of the term established by law shall be effective until the expiration of said term.

Three (3) members of the Board shall constitute a quorum and the decisions shall be made by a majority vote of the members that constitute a quorum on the Board. The Chairperson shall sign every official document issued by the Board of Examiners. The Board shall meet as many times as needed to perform its functions, upon prior summons from the Chairperson.

The Board shall have an official seal. Each member of the Board, including public officials or employees, shall be entitled to per diems of fifty dollars ($50) for each day or part thereof that they attend meetings or sessions of the Board, as well as reimbursement for the traveling expenses [incurred], pursuant to the regulations of the Secretary of the Treasury applicable thereto. As of January 1, 1997, the members of the Board shall receive per diems equal to the minimum per diem established for the members of the Legislature, except for the Chairperson of the Board who shall receive a per diem equal to one hundred and thirty-three percent (133%) of the per diem received by the other members of the Board.

The payment of per diems and mileage to which each member of the Board is entitled shall be limited to a maximum of twelve (12) meetings per year.

The Governor of Puerto Rico may dismiss a Board member from office upon notice and hearing for lack of professional ethics, for violations of this subchapter, for immoral conduct, for negligence, inefficiency or incompetence in the performance of his/her duties or upon conviction for an offense implying moral turpitude or for any other established and justified cause.
