Any person who obtains or attempts to obtain any benefit from another by claiming or pretending that he/she is in a position to influence the conduct of a public officer or employee in the exercise of his/her duties shall incur a fourth degree felony.
A third degree felony sentence shall be imposed if the person obtains the benefit pursued.
The court may also impose restitution.
