Section 41.06.185 - Enhanced oil or gas recovery(a) Except as provided in (b) of this section, the provisions of AS 41.06.105 - 41.06.210 do not apply to applications filed with the commission proposing to use carbon dioxide for enhanced oil or gas recovery.(b) The commission may adopt regulations that allow enhanced oil or gas recovery and related well activities to be converted to a storage facility. The regulations must require that, in considering whether to approve a conversion, and upon conversion, the provisions of AS 41.06.105 - 41.06.210 apply. The regulations may impose additional requirements to AS 41.06.105 - 41.06.210, or describe specific situations in which the requirements of AS 41.06.105 - 41.06.210 are waived, to ensure that the objectives of AS 41.06.105 - 41.06.210 are met.Added by SLA 2024, ch. 23,sec. 39, eff. 10/29/2024.
