(a) If the commission denies the application for a product with a valid COLA or fails to act on the application within the time required by § RSA 45.7 of this title, the applicant is entitled to an administrative hearing before the State Office of Administrative Hearings. (b) To request a hearing under this chapter, the applicant must file a written request for hearing with the commission within ten (10) business days of: (1) receiving notification from the commission that product registration has been denied; or (2) the expiration of the time limit for commission action, if the commission has not either approved or denied the application.16 Tex. Admin. Code § 45.8
