Section 5005.3 - Subscription costs(a)Minimums. For each subscription, a minimum of one game panel must be selected for a minimum number of weeks or drawings, as determined by the commission.(b)Game panels. A subscription may be for one or more game panels, as may be determined by the commission.(c)Cost. The cost of a subscription shall be determined by the commission. The commission may establish a subscription account program through which a subscriber may purchase a subscription or subscriptions and receive payment of a prize, as determined by the commission. The commission may require that a subscriber maintain a minimum balance in such a subscription account to continue to participate in the program.(d)Reservation of commission rights. The commission reserves the right to alter, temporarily or permanently, the cost of a subscription at the discretion of the commission. The commission reserves the rights to suspend or cancel any drawing or the game itself or change the prize structure, frequency of draws or draw dates. In the event of such a change, an affected subscriber will receive participation in a revised game, equivalent in value to the remainder of such subscriber's subscription, or a refund, at the sole option of the commission.(e)Commission determinations. Any determination by the commission described in this section may be made for any of the following reasons: (1) to make the subscription program more appealing or convenient for players;(2) to further the commission's mission of raising revenue for aid to education; or(3) to allow the commission to administer the subscription program more effectively.N.Y.
