Section 11-186-77 - Conditional certification

At its discretion, the agency may issue a conditional certification to an application which, by modification of specific items of the application, may successfully meet the criteria for the issuance of a certificate of "need. The agency shall not make the decision subject to any condition unless the condition directly relates to criteria established by law. The agency shall notify the applicant in writing of the modifications required and of the time period within which the modifications are to be made. The agency shall establish a time period not to exceed one hundred fifty days from the date of the conditional certification within which the applicant shall certify in writing to the agency that the required modifications to the application have been made. The agency shall deny any application in which the required modifications have not been made within the time period, established by the agency.
