Section 30.333 - Exception Reporting(1) If a generator does not receive a copy of the manifest with the handwritten signature of the owner or operator of the designated facility within 35 days of the date the hazardous waste was accepted by the initial transporter, the generator shall contact the transporter or the owner or operator of the designated facility, or both, if necessary, to determine the status of the hazardous waste.(2) If a generator does not receive a copy of the manifest with the handwritten signature of the owner or operator of the designated facility within 45 days of the date the hazardous waste was accepted by the initial transporter, the generator shall submit an Exception Report to the Department. If the designated facility is located outside of Massachusetts, the generator shall also submit an Exception Report to the State in which the designated facility is located. The Exception Report shall include the following:(a) A legible copy of the manifest for which the generator does not have confirmation of delivery; and(b) A cover letter signed by the generator or an authorized representative of the generator explaining the efforts taken to locate the hazardous waste and the results of those efforts.Amended by Mass Register Issue 1522, eff. 5/24/2024.Amended by Mass Register Issue 1524, eff. 5/24/2024.
