Section 13549 - Notice of the Impending Development
(a) At least thirty (30) working days prior to beginning development, the governing authority shall notify in writing the following parties of the nature and location of the impending development: the Commission, contiguous local governments, owners of each parcel of record within 100 feet of the proposed development, persons residing within 100 feet of the proposed development, and all other interested persons and agencies who have requested such notice. The governing authority shall post conspicuous notice of such impending development at the proposed site. Notice to the Commission, and interested persons and agencies who have so requested shall be accompanied by sufficient supporting information to allow determination of whether such development is consistent with the certified LRDP. All notification and physical posting for the impending development shall meet the requirements specified in the certified LRDP.
(b) Within ten (10) working days of the receipt of a notice of the impending development, the executive director shall review the notice. If there is insufficient supporting information to determine whether the proposed development is consistent with the certified LRDP, the executive director shall inform the governing authority of what further information is needed to make such determination. The notice shall be deemed filed when all necessary supporting information has been received by the executive director.
(c) No construction shall commence until at least thirty (30) days after the notice is filed in the office of the Commission.
(d) This section shall not apply to those development projects defined pursuant to Section 13511(g).
