The Secretary shall give every applicant for federal funds for a construction or modernization project of a health facility an opportunity for a fair hearing. If after affording a reasonable opportunity for the development and submission of applications in order of relative need, the Secretary finds that the application complies with the requirements of this chapter and is otherwise in agreement with the state plan, he shall approve such application and shall recommend and forward it to the Secretary of Health, Education and Welfare or to the Surgeon General, as the case may be.
