(a) Any person not subject to this Code who:
(1) Has been duly subpoenaed to appear as a witness or to produce books and/or records before a court-martial, military commission, court of inquiry or any other court or military board or before any military or civil officer designated to take a deposition to be read in evidence before such court, commission or board;
(2) has been duly paid or tendered the fees and mileage of a witness at the rates allowed to witnesses attending the courts of the Commonwealth of Puerto Rico, and
(3) willfully refuses to appear or refuses to testify as a witness or to produce any evidence in his power, which that person may have been legally subpoenaed to produce,
shall be guilty of an offense against the Commonwealth of Puerto Rico.
(b) Any person guilty of the offense mentioned in subsection (a) of this section, shall be prosecuted before the Court of First Instance of Puerto Rico which court is hereby empowered with jurisdiction over such cases.
If such person is convicted, he shall be punished in the same manner as such offense is punished under the laws of the Commonwealth of Puerto Rico.
