Section 770-X-5-.13 - Transfers And Acquisitions(1)(a) The telephone utility shall notify the Commission prior to the sale or transfer of any telephone system, in whole or in part of such system.(b) This rule does not apply to the sale or transfer of any equipment or material not in actual service, nor to the purchase or sale by a telephone utility of service lines or equipment connected to its system.(2) All telephone utilities, including local exchange carriers, interexchange carriers, resellers, operator service providers, COCOTs, etc., shall file a written report with the Secretary of the Commission within 30 days after control of the telephone utility changes or within 30 days after the telephone utility acquires another company regulated by the Commission. The report shall include: (a) A brief description of the transaction, including the effective date.(b) Location of the financial records of the telephone utility, if control changed, or of the acquired company, if an acquisition occurred.(c) The name and telephone number of a contact person familiar with the transaction.(d) A brief description of any tariff changes anticipated in the near future.(e) The new address to be used for official notices, if the address changed.Ala.
