Section 78B-3-105 - Definition of heirsAs used in Sections 78B-3-106 and 78B-3-107, "heirs" means the following surviving persons:
(1) the decedent's spouse;(2) the decedent's children as provided in Section 75-2-114;(3)(a) the decedent's natural parents; or(b) if the decedent was adopted, the decedent's adoptive parents;(4) the decedent's stepchildren who: (a) are younger than 18 years old at the time of decedent's death; and(b)(i) received financial support from the decedent at the time of decedent's death; or(ii) resided with the decedent on at least a part-time basis at the time of the decedent's death; or(5) any blood relative as provided by the law of intestate succession if the decedent is not survived by a person under Subsection (1), (2), or (3).Amended by Chapter 190, 2022 General Session ,§ 1, eff. 5/4/2022.Renumbered and Amended by Chapter 3, 2008 General Session.
