Current through the 2024 Fourth Special Session
(1) Notwithstanding Title 78B, Chapter 3a, Venue for Civil Actions, and except as provided in Subsection (2), a person shall bring an action involving a trust, if the action is brought in the district court, in: (a) the county in which the trust's principal place of administration is or will be located; or(b) if the trust is created by a will and the estate is not yet closed, the county in which the decedent's estate is being administered.(2) Notwithstanding Title 78B, Chapter 3a, Venue for Civil Actions, and if a trust has no trustee, a person shall bring an action for the appointment of a trustee, if the action is brought in the district court, in: (a) a county of this state in which a beneficiary resides;(b) a county in which any trust property is located; or(c) if the trust is created by a will, the county in which the decedent's estate was or is being administered.Amended by Chapter 158, 2024 General Session ,§ 123, eff. 7/1/2024.Repealed and Re-enacted by Chapter 89, 2004 General Session.
