Section 53G-8-405 - Liability for release of information(1) The district superintendent, district superintendent's designee, principal, and any staff member notified by the principal may not be held liable for information which may become public knowledge unless it can be shown by clear and convincing evidence that the information became public knowledge through an intentional act of the superintendent, superintendent's designee, principal, or a staff member.(2) A person receiving information under Section 53G-8-403 or 80-6-103 is immune from any liability, civil or criminal, for acting or failing to act in response to the information unless the person acts or fails to act due to malice, gross negligence, or deliberate indifference to the consequences.Amended by Chapter 20, 2024 General Session ,§ 19, eff. 5/1/2024.Amended by Chapter 262, 2021 General Session ,§ 27, eff. 9/1/2021.Amended by Chapter 354, 2020 General Session ,§ 76, eff. 5/12/2020.Renumbered from § 53A-11-1004 and amended by Chapter 3, 2018 General Session ,§ 270, eff. 1/24/2018.Amended by Chapter 3, 2008 General Session.
