Section 8501.153 - State Supervision and Approval(a) The Texas Commission on Environmental Quality shall consider the adequacy of, and decide whether to approve, any flood control or conservation improvement plan that: (1) is devised by the authority to achieve a plan or purpose for which the authority is created; and(2) contemplates improvements that are to be supervised by the commission under general law.(b) Before the authority establishes a diversion point or constructs a canal, pumping plant, or other work under this chapter, the authority must:(1) present the plans and specifications for the project to the Texas Commission on Environmental Quality; and(2) obtain the approval of the commission.Tex.
