Section 531.0202 - Abolition of State Agencies and Entities; Effect of Transfers(a) Each of the following state agencies and entities is abolished on a date that is within the period prescribed by Section 531.02001(1), that is specified in the transition plan required under Section 531.0204 for the abolition of the agency or entity, and that occurs after all of the agency's or entity's functions have been transferred in accordance with Section 531.0201: (1) the Department of Assistive and Rehabilitative Services;(2) the Health and Human Services Council;(3) the Aging and Disability Services Council;(4) the Assistive and Rehabilitative Services Council;(5) the State Health Services Council; and(6) the Texas Council on Autism and Pervasive Developmental Disorders.(b) The following state agency and entity are abolished on a date that is within the period prescribed by Section 531.02001(2), that is specified in the transition plan required under Section 531.0204 for the abolition of the state agency or entity, and that occurs after all of the state agency's or entity's functions have been transferred to the commission in accordance with Sections 531.0201 and 531.02011: (1) the Department of Aging and Disability Services; and(2) the Office for the Prevention of Developmental Disabilities.(c) The abolition of a state agency or entity listed in Subsection (a) or (b) and the transfer of its functions and related obligations, rights, contracts, records, property, and funds as provided by this subchapter and the transfer of functions and related obligations, rights, contracts, records, property, and funds to or from the Department of Family and Protective Services and from the Department of State Health Services as provided by this subchapter do not affect or impair an act done, any obligation, right, order, permit, certificate, rule, criterion, standard, or requirement existing, or any penalty accrued under former law, and that law remains in effect for any action concerning those matters.Tex.
