Section 158.306 - Delivery of Notice of Application for Judicial Writ of Withholding; Time of Delivery(a) A notice of application for judicial writ of withholding may be delivered to the obligor by:(1) hand delivery by a person designated by the Title IV-D agency or local domestic relations office;(2) first-class or certified mail, return receipt requested, addressed to the obligor's last known address or place of employment; or(3) by service of citation as in civil cases generally.(b) If the notice is delivered by mailing or hand delivery, the party who filed the notice shall file with the court a certificate stating the name, address, and date on which the mailing or hand delivery was made.(c) Notice is considered to have been received by the obligor: (1) if hand delivered, on the date of delivery;(2) if mailed by certified mail, on the date of receipt;(3) if mailed by first-class mail, on the 10th day after the date the notice was mailed; or(4) if delivered by service of citation, on the date of service.Amended by Acts 1997, 75th Leg., ch. 911, Sec. 54, eff. 9/1/1997.Added by Acts 1995, 74th Leg., ch. 20, Sec. 1, eff. 4/20/1995.
