Section 751-29 - Reorganization Plan No. 2 of 1981-Pennsylvania Historical and Museum Commission-Transfer of powers and duties

Section 1. The functions, powers and duties of the Secretary of Community Affairs and the Bureau of Land Records with regard to the custody and care of deeds and other instruments relating to the titles to real estate of the Commonwealth as set forth in the act of April 4, 1919 (P.L. 44, No. 33), entitled, as amended, "An act making the Secretary of Community Affairs the custodian of all deeds, contracts, maps, surveys, policies of title insurance, abstracts of titles, and other documents or instruments relating to the titles to real estate owned or hereafter to be acquired by the Commonwealth," are hereby transferred to the Pennsylvania Historical and Museum Commission.

Section 2. The functions, powers and duties of the Secretary of Community Affairs and the Bureau of Land Records with regard to the conveyance of land, the release of liens and the administration of public lands and records thereof and all other powers and duties as set forth in the act of July 9, 1959 (P.L. 510, No. 137), known as the "Pennsylvania Public Lands Act," are hereby transferred to the Pennsylvania Historical and Museum Commission.

Section 3. The functions, powers and duties of the Secretary of Community Affairs and the Bureau of Land Records with regard to the compilation of warrantee tract maps as set forth in the act of June 13, 1907 (P.L. 621, No. 483), entitled, as amended, "An act authorizing and directing the Secretary of Community Affairs to compile and publish connected warrantee tract maps of each of the several counties of this Commonwealth; making an appropriation for the work of compilation, and directing the manner of sale and distribution of the same," are hereby transferred to the Pennsylvania Historical and Museum Commission.

Section 4. The functions, powers and duties of the Secretary of Community Affairs and the Bureau of Land Records with regard to the collection of fees as set forth in the act of June 30, 1959 (P.L. 492, No. 117), entitled, as amended, "An act fixing the fees to be charged by the Department of Community Affairs," are hereby transferred to the Pennsylvania Historical and Museum Commission.

Section 5. There are hereby transferred to the Pennsylvania Historical and Museum Commission to be used, employed and expended in connection with the functions, powers and duties transferred by sections 1 through 4 of this Reorganization Plan, contract obligations, if any, records, files, space, property, supplies, personnel and equipment now being used or held in connection with such functions, powers and duties, and the unexpended balances of appropriations, allocations and other funds available or to be made available for use in connection with such functions, powers and duties.

Section 6. The act of June 13, 1907 (P.L. 621, No. 483), entitled, as amended, "An act authorizing and directing the Secretary of Community Affairs to compile and publish connected warrantee tract maps of each of the several counties of this Commonwealth; making an appropriation for the work of compilation, and directing the manner of sale and distribution of the same," the act of April 4, 1919 (P.L. 44, No. 33), entitled, as amended, "An act making the Secretary of Community Affairs the custodian of all deeds, contracts, maps, surveys, policies of title insurance, abstracts of titles, and other documents or instruments relating to the titles to real estate owned or hereafter to be acquired by the Commonwealth," the act of June 30, 1959 (P.L. 492, No. 117), entitled, as amended, "An act fixing the fees to be charged by the Department of Community Affairs," and the act of July 9, 1959 (P.L. 510, No. 137), known as the "Pennsylvania Public Lands Act," are suspended insofar as they conflict with this Reorganization Plan.
