Section 12192 - Filling of vacancies
(a) During the recess of the council, the mayor shall have power to fill all vacancies that may happen in offices to which he may appoint by and with the advice and consent of the council, and any such appointment shall be submitted to the council at its next meeting, and, if not rejected within thirty days thereafter, the same shall be considered confirmed.
(b) Whenever any elective officer of any such city shall die or become incapacitated for fulfilling the duties of his office, his place, except where other provision is made for filling the vacancy, shall be filled, by a vote of the council, until the next municipal election occurring more than thirty days thereafter and until the qualification of a successor in the office.
