Section 690-509 - Relation to permitThe following apply if the department finds that an operator has demonstrated a lack of intent or ability to comply with this act, a regulation under this act or any approval, standard or order under this act:
(1) The department may take any action it deems appropriate regarding the operator's permits, including denial of applications for new, renewed or amended permits and suspension or revocation of existing permits.(2) Before taking action under paragraph (1), the department shall provide the operator with an opportunity to demonstrate to the department the operator's intent and ability to comply.2008, July 7, P.L. 654, No. 55, §509, effective in 180 days [ 1/5/2009].
