Section 690-502 - Restraining violations(a) Department.--In addition to any other remedies provided by law, the department may seek an injunction to restrain any of the following: (1) Violation of this act, a regulation promulgated under this act or any approval, standard, order or permit issued under this act.(2) Creation and maintenance of a threat to the health and safety of miners and individuals in and about mines.(b) Court.--(1) In a proceeding under subsection (a), the court may do any of the following:(i) Issue an injunction if it finds reasonable cause to believe that the respondent is engaging in conduct which:(A) violates this act, a regulation promulgated under this act or any approval, standard or order issued under this act; or(B) poses a threat to the health and safety of miners and individuals in and about mines.(ii) Levy civil penalties against the respondent.(2) The Court of common pleas and the Commonwealth Court are granted jurisdiction to hear and decide proceedings brought under subsection (a).(c) Bond.--The department is not required to post bond in connection with proceedings brought under this section.2008, July 7, P.L. 654, No. 55, §502, effective in 180 days [ 1/5/2009].
