It shall be unlawful to place any sign, banner, or advertising matter of any kind whatsoever on or across any State highway or on or across any structure within the legal limits of any State highway without first having obtained the written consent of the department. Any person violating the provisions of this section shall, upon summary conviction, be sentenced to pay a fine of not less than four dollars ($4.00) nor more than twenty dollars ($20.00). All such fines shall be paid into the county treasury to be used only for the construction or repair of public roads or highways.
Any such sign, banner, or advertising matter placed without the consent of the department is hereby declared to be a public nuisance, and may be abated by the department with or without notice to the persons responsible for the placing thereof.
