Section 7130.320 - Protection from contamination(a) Water supply.--The operator shall restore or replace any water supply which has been found or presumed pursuant to section 319 to be contaminated with radioactive material as a result of operations at the regional facility.(b) Contamination in general.--Any landowner experiencing radioactive contamination within three miles of the boundary of the regional facility may notify the department and request that an investigation be conducted. Within ten days of such notification, the department shall investigate any such claims and shall, within 60 days of the notification, make a determination. If the department finds that the radioactive contamination was caused by the operation of the regional facility or if it presumes the operator of a regional facility responsible for contamination, then it shall issue such orders to the operator as are necessary to abate the radioactive contamination and replacement of any contaminated water supply.1988, Feb. 9, P.L. 31, No. 12, § 320, imd. effective.
