Section 300.5 - Criminal penalty(a) Summary offense.--(1) A person who violates section 4 commits a summary offense and shall, upon conviction, be sentenced to pay a fine of not less than $100.(2) A person who violates section 4 after being convicted under paragraph (1) commits a summary offense and shall, upon conviction, be sentenced to pay a fine of not less than $300.(b) Misdemeanor.--A person who violates section 4 after being convicted under paragraphs (1) and (2) commits a misdemeanor of the third degree and shall, upon conviction, be sentenced to pay a fine of not less than $1,000.1991, Aug. 6, P.L. 321, No. 32, § 5, effective in 30 days.
