Section 3219.1 - Well control emergency response(a) Contracts.--The department may enter into contracts with well control specialists in order to provide adequate emergency response services in the event of a well control emergency. The department shall make available upon request by a county information relating to contracts with well control specialists.(b) Civil immunity.--Except as set forth in subsection (c), a well control specialist with which the department has entered into a contract under subsection (a) shall be immune from civil liability for actions taken in good faith to carry out its contractual obligations.(c) Nonapplicability.--Subsection (b) shall not apply to damage arising from any of the following: (1) Breach of the contract under subsection (a).Added by P.L. 87 2012 No. 13, § 1, eff. 4/14/2012.
