Ohio Rev. Code § 109.112

Section 109.112 - [Effective 1/1/2025] Notice of receipt of funds; disposition of funds
(A) If the state of Ohio or any agency or officer of the state is named in an order or judgment of a court or a settlement or compromise of claims as the recipient of any money to be collected or received by the office of the attorney general under section 109.111 of the Revised Code, the office shall notify the director of budget and management and the director of the legislative service commission of the amount of money at issue and the terms of the order, judgment, settlement, or compromise and any applicable federal or state law.
(B)
(1) For amounts awarded, adjudged, settled upon, or compromised to under division (A) of this section that are or will be less than five million dollars in total when fully collected or received, the director of budget and management, in consultation with the office of the attorney general, shall determine , consistent with the terms of the order, judgment, settlement, or compromise and as otherwise expressly provided by law, the appropriate custodial fund or funds within the state treasuryto transfer the money.

As money is collected or received under division (B)(1) of this section, the director of budget and management shall transfer the money from the attorney general court order and settlement fund to the appropriate custodial fund or funds as determined by the director.

Upon any determination or transfer made under division (B)(1) of this section, the director of budget and management or office of the attorney general shall provide notice thereof, including the amount at issue and rationale supporting the determination or transfer, to the director of the legislative service commission.

(2) For amounts awarded, adjudged, settled upon, or compromised to under division (A) of this section that are or will be five million dollars or more in total when fully collected or received, the director of budget and management shall, as money is collected or received hereunder, transfer the money from the attorney general court order and settlement fund to the large settlements and awards fund established under section 109.113 of the Revised Code.

Division (B)(2) of this section neither applies to nor includes any of the following:

(a) Amounts awarded under division (B)(1) or (2) of section 109.11 of the Revised Code;
(b) Amounts payable to the state or a political subdivision for collection purposes under sections 109.08, 109.081, 131.02, and 5703.06 of the Revised Code;
(c) Amounts payable to a specified person or class of persons who experienced a concrete and particularized injury directly traceable to the amount awarded, adjudged, settled upon, or compromised to.

When making any transfer under division (B)(2) of this section, the director of budget and management or office of the attorney general shall provide notice thereof, including the amount at issue and the terms of the award, judgment, settlement, or compromise and any applicable federal or state law, to the director of the legislative service commission.

135th General Assembly, HB 101, §803.30 provides in part that the amendments to this section are prospective in their operation and have no effect on an order or judgment of any court or any settlement or other compromise of claims issued, entered, or agreed to before January 1, 2025, even if an amount awarded, adjudged, settled upon, or comprised to has not been received in full by the state or an agency or officer of the state before then.
