Section 44-06.1-07 - Authority to refuse to perform notarial act1. A notarial officer may refuse to perform a notarial act if the officer is not satisfied that: a. The individual executing the record is competent or has the capacity to execute the record; orb. The individual's signature is knowingly and voluntarily made.2. Except as prohibited by law other than the provisions of this chapter, a notarial officer may refuse to perform a notarial act.Added by S.L. 2011, ch. 334 (HB 1136),§ 3, eff. 8/1/2011.
