Section 45:15-16.76 - Determinations by commission; cease and desist ordera. If the commission determines after notice and hearing that a person has: (1) Violated any provision of this act;(2) Directly or through an agent or employee engaged in any false, deceptive, or misleading advertising, promotional or sales methods in the State to offer or dispose of an interest in the timeshare plan;(3) Made any material change in the plan of disposition and development of the timeshare plan subsequent to the order of registration without first complying with the provisions of section 11 of this act;(4) Disposed of any timeshare plan which have not been registered with the commission; or(5) Violated any lawful order or rule or regulation of the commission; The commission may issue an order requiring the person to cease and desist from the unlawful practice and to take such affirmative action as in the judgment of the commission will carry out the purposes of this act.
b. If the commission makes a finding of fact in writing that the public interest will be irreparably harmed by delay in issuing an order, the commission may issue a temporary cease and desist order. Every temporary cease and desist order shall include in its terms a provision that upon request a hearing will be held within 15 days of the receipt of the request.Added by L. 2006, c. 63, s. 27, eff. 10/31/2006.
