Section 18A:7G-34.1 - Contractor, good standing, school facilities projects, corrective action plana. As part of the application process established under section 59 of P.L. 2000, c. 72 (C.18A:7G-33) for the prequalification of a contractor that desires to bid on school facilities projects, the development authority shall seek certification from the Department of Labor and Workforce Development and the Department of the Treasury that the contractor is in substantial good standing with the respective department or has entered into an agreement with the respective department that includes a practical corrective action plan for the contractor.b. As part of the application process established under section 59 of P.L. 2000, c. 72 (C.18A:7G-33) for the prequalification of a contractor that desires to bid on school facilities projects, the development authority shall undertake a moral integrity review, which shall include a criminal history record check, judgment search, and lien search of:(2) the contractor's corporate directors or officers;(3) any employee of the contractor who serves in a supervisory capacity or that is empowered to make discretionary decisions with respect to bids or contracts for public works contracts; or(4) any individual who owns five percent or more of any class of stock in the corporation or is a five percent or more partner in the firm.c. The development authority shall not approve the application of a contractor for prequalification to bid on a school facilities projects if the contractor has been convicted of a criminal offense under local, State, or federal law or if, at the time of the application, the contractor is disbarred, suspended, or disqualified from State, development authority, or federal government contracting.d. The development authority shall not approve the application of a contractor for prequalification to bid on school facilities projects if the contractor is prohibited from contracting with any public body pursuant to subsection d. of section 1 of P.L. 2019, c. 366 (C.34:1A-1.16).Added by L. 2023, c. 311, s. 15, eff. 1/16/2024.
