The board may condemn for the use of the district, any land or property within the district not previously acquired or condemned by order or judgment of the court, according to the procedure provided by law for the appropriation of land or other property as provided in chapter 523, for the condemnation of property for public use, except that:
(1) The original jurisdiction for such condemnation shall rest in the court as such court is defined in this chapter, and(2) Any provisions of chapter 523 which conflict with the provisions of this chapter do not apply herein. Whenever the constitution of the state permits, the board shall have the right to exercise the power of excess condemnation on such property as the court decrees as reasonable and desirable for the district to acquire.
