Section 79-29-1201 - Construction and application(1) The rule that statutes in derogation of the common law are to be strictly construed shall have no application to this chapter.(2) It is the policy of this chapter to give the maximum effect to the principle of freedom of contract and to the enforceability of operating agreements.(3) Unless the context otherwise requires, as used herein, the singular shall include the plural and the plural may refer to the singular. The captions contained herein are for the purposes of convenience only and shall not control or affect the construction of this chapter.(4) As used herein, the words "include," "includes" and "including" will be deemed to be followed by the phrase "without limitation," whether or not such phrase is included therein.Laws, 1994, ch. 402, § 84; Laws, 2010, ch. 532, § 1, eff. 1/1/2011.
