In cases where the appointing authority has refused to reinstate a petitioner, and the case is finally decided in favor of the petitioner, the official in charge of deciding the case on appeal, or the court, in the proper case, may order said appointing authority to pay the unreceived salaries from the date the petition for reinstatement was received.
