§ 958. Penalties

The Commissioner is hereby authorized to impose and collect administrative fines of not less than one hundred dollars ($100) or more than ten thousand dollars ($10,000) for any violation of the provisions of this chapter or of the rules and regulations promulgated thereunder. Furthermore, the Commissioner is hereby empowered to direct the reimbursement of the money that a financial institution has unduly withheld from a client. Whenever the nature of the violation of this chapter or of the rules and regulations, or orders or resolutions, issued by the Commissioner so justify it, in addition to the administrative fine authorized in the foregoing paragraph, the Commissioner may act in accordance with the power conferred in §§ 7001 et seq. of Title 7, and may initiate the appropriate judicial action against the violator. Any natural or juridical person who violates the provisions of this chapter or of the regulations that, from time to time, are prescribed by the Financial Board and/or by the Commissioner, shall be guilty of a misdemeanor and, upon conviction, be punished with a fine of not less than ten thousand dollars ($10,000) or imprisonment for a term of not less than sixty (60) days nor more than twelve (12) months; or both penalties at the discretion of the court. Each transaction in violation of the previous provision constitutes a separate violation and shall be punishable as such.
