It shall be unlawful for any director, official, agent or employee of any bank or foreign bank to certify any check drawn against said bank unless the person or company drawing the check has on deposit with the bank, at the time the check is certified, an amount not less than the amount specified in such a check. Any check thus certified by duly authorized officials shall become a valid obligation against such a bank or foreign bank when in possession of any holder in good faith. Any director, official, agent or employee of any bank or foreign bank who, knowingly acts in violation of the provisions of this section shall be deemed guilty of a felony and punished with a term of imprisonment of not less than one (1) nor more than two (2) years.
