Any driver who fails to stop his/her vehicle or in such circumstances to meet the requirements expressed in § 5101 of this title, shall be guilty of a misdemeanor and, upon conviction, shall be punished by a term of imprisonment not to exceed six (6) months, by a fine of not more than five thousand dollars ($5,000), or both penalties at the discretion of the court. If a person is injured or dies as a result of the accident, the driver shall be guilty of a felony and, upon conviction, shall be punished by a fixed term of imprisonment of three (3) years.
The Secretary shall revoke the driver’s license or permit and all driving privileges granted to a nonresident who has been convicted of violating this section.
