Section 9-563 - [Effective 1/1/2025] [Consistent state licensing](a) To establish consistent licensing practices between Kansas and other states, the commissioner is hereby authorized to: (1) Implement all licensing provisions of this act in a manner consistent with other states that have adopted this act or multistate licensing processes; and(2) participate in nationwide protocols for licensing cooperation and coordination among state regulators, if such protocols are consistent with this act.(b) The commissioner is authorized to establish relationships or contracts with the national multistate licensing system and registry or other entities designated by the national multistate licensing system and registry to: (1) Collect and maintain records;(2) coordinate multistate licensing processes and supervision processes;(4) facilitate communication between the commissioner and licensees or other persons subject to this act.(c) The commissioner may utilize the nationwide multistate licensing system and registry for all aspects of licensing in accordance with this act, including, but not limited to, license applications, applications for acquisitions of control, surety bonds, reporting, criminal history background checks, credit checks, fee processing and examinations.(d) The commissioner may utilize nationwide multistate licensing system and registry forms, processes and functionalities in accordance with this act. If the nationwide multistate licensing system and registry does not provide functionality, forms or processes for the provision of this act, the commissioner is authorized to implement the requirements in a manner that facilitates uniformity regarding the licensing, supervision, reporting and regulation of licensees that are licensed in multiple jurisdictions.(e) The commissioner may establish new requirements or waive or modify, in whole or in part, any or all of the existing requirements as reasonably necessary to participate in the nationwide multistate licensing system and registry through the adoption of any rules and regulations adopted or an order issued or the issuance of an order.(f) This section shall take effect on and after January 1, 2025.Added by L. 2024, ch. 64,§ 9, eff. 7/1/2024.
