Section 16-42-1-27 - New trial; appeal; appeal bond(a) A defendant may move for a new trial and may appeal to the supreme court or the court of appeals in the manner provided by law for appeals in civil actions.(b) An appeal bond shall be fixed in an amount that covers the reasonable costs of preserving the condemned merchandise for the probable time of appeal and the court costs.(c) If an appeal is not prosecuted to determination or if the judgment of the trial court is affirmed, the defendant bringing the appeal is liable for the following: (1) The costs adjudged against the defendant or defendants in the trial court.(3) The actual reasonable cost of preserving the condemned merchandise during the appeal period.(d) The court of appeals and the supreme court shall dispose of appeals brought under this chapter as speedily as possible with due regard to the rights of the parties involved.Pre-1993 Recodification Citation: 16-1-28-31.
