Any communication made by or to a person who is deaf or hard of hearing with the assistance of a person operating special telecommunications equipment capable of serving the needs of persons who are deaf or hard of hearing shall be deemed to be confidential and privileged and shall not be disclosed by such operator in any civil or criminal case or proceeding or in any legislative or administrative proceeding, unless the person making the confidential communication waives such privilege.
