Section 4e-73 - Home and CommunityBased Services Provider Payments
(a) As used in this section, (1) "Home and Community-Based Services Provider Payments" means payments disbursed by state agencies to providers of health and human services that were received by such agencies through Section 9817 of the American Rescue Plan Act of 2021, and (2) "attempt to recover or otherwise offset" means (A) reductions by state agencies in contracted amounts for such providers for the same or similar services from one contract period to the next contract period, or (B) demands for reimbursement of funds in the amount of any Home and CommunityBased Services Provider Payments.
(b) No state agency contracting with a provider of health and human services may attempt to recover or otherwise offset Home and Community-Based Services Provider Payments obtained or retained by such provider. Nothing in this subsection shall require state agencies to take action that would jeopardize federal claims or Medicaid reimbursements.
