Section 17a-NEW - [Newly enacted section not yet numbered] Medicaid claims for eligible student(a) As used in this section, "local educational agency" or "LEA" has the same meaning as provided in 20 USC 1401, as amended from time to time.(b) To the extent permissible under federal law, and subject to federal approval and within available funding specifically appropriated for this purpose, the Commissioner of Social Services, in consultation with the Commissioner of Education, shall seek federal approval to amend the Medicaid state plan to expand Medicaid coverage for health services provided by or on behalf of a local educational agency to any student who is enrolled in Medicaid regardless of whether such student qualifies for services under Part B of the Individuals with Disabilities Education Act, 20 USC 1400 et seq., or section 504 of the Rehabilitation Act, as each is amended from time to time. The commissioner shall submit such Medicaid state plan amendment not later than October 1, 2025.(c) To the extent permissible under federal law, and subject to federal approval and within available appropriations, a local educational agency shall be authorized by the Commissioner of Social Services to submit Medicaid claims for each student who is eligible for Medicaid and is receiving Medicaid-covered school-based services unless such student's parent or legal guardian opts out of authorizing the local educational agency from billing Medicaid for services provided for the student.(d) The Commissioner of Social Services, in consultation with the Commissioner of Education, shall issue written guidance regarding health care services eligible for Medicaid reimbursement to be disseminated to each local or regional board of education.(e) Not later than January first annually, the Commissioner of Social Services, in consultation with the Commissioner of Education, shall file a report, in accordance with the provisions of section 11-4a of the general statutes, on Medicaid reimbursement for school-based health care services with the joint standing committees of the General Assembly having cognizance of matters relating to appropriations, children, education and human services.
