Section 29:2PPP - [Effective the later of (i) one full calendar month following the calendar month in which the secretary receives all federal approvals deemed necessary to implement said sections; or (ii) October 1, 2024] Essential Community Provider Trust Fund

There shall be established and set up on the books of the commonwealth a separate, non-budgeted special revenue fund known as the Essential Community Provider Trust Fund. There shall be credited to the fund:

(i) any funds that may be appropriated or transferred for deposit into the fund; and
(ii) any income derived from investment of any money credited to the fund. In conjunction with the preparation of the statutory basis financial report required by section 12 of chapter 7A, the comptroller shall prepare and issue an annual report detailing the revenues and expenditures of the fund. Amounts credited to the fund shall not be subject to further appropriation. Money remaining in the fund at the end of a fiscal year shall not revert to the General Fund and shall be available for expenditure in subsequent fiscal years. To accommodate timing discrepancies between the receipt of revenue and related expenditures, the comptroller may certify for payment amounts not to exceed the most recent revenue estimates as certified by the secretary of health and human services to be transferred, credited or deposited under this section. The secretary shall administer the fund and disburse money from the fund to pay acute hospitals and community health centers to maintain financial stability for the provision of healthcare services to ensure access to care, provide for public health and promote equity.
