Section 362 - Certain cities; term of office of commissioner and health officer; removal1. The commissioner of health in cities having a population of fifty thousand to one hundred seventy-five thousand, and the health officer in cities having a population of less than fifty thousand, respectively, shall serve for a term of four years.2.(a) The commissioner of health in cities having a population of fifty thousand to one hundred seventy-five thousand and the health officer in cities having a population of less than fifty thousand, shall not be removed by the official or body appointing him during the term for which he shall have been appointed other than for inefficiency, neglect of duty or misconduct in office, upon written charges and after an opportunity of being publicly heard in his defense.(b) A copy of such charges shall be personally served upon such commissioner of health in cities having a population of fifty thousand to one hundred seventy-five thousand or health officer in cities having a population of less than fifty thousand and he shall be given not less than five days' notice of the time and place of the hearing.N.Y.
