Section 6-62-101 - Sale of water(a)(1) State-supported institutions of higher education are authorized to perform contracts with private persons, made and entered into prior to June 10, 1965, whereby the institutions have agreed to furnish surplus water to those persons from supplies owned by the institutions.(2) However, state-supported institutions of higher education shall not make or enter into any new contract or renewal of an existing contract to furnish water to any private person from supplies owned by the institutions.(3) Any such institution of higher education may cease to furnish water to any private person being furnished surplus waters if the board of the institution shall determine that the water is needed for the purposes of the institution.(b) The provisions of this section shall not be applicable to the research and extension centers and stations of the University of Arkansas or any other research facilities of the University of Arkansas.(c) Any contract or renewal of a contract made and entered into in violation of the terms of this section shall be void.Amended by Act 2023, No. 124,§ 8, eff. 8/1/2023.Acts 1965, No. 388, §§ 1, 2; A.S.A. 1947, §§ 80-3335, 80-3336.
