Section 16-85-403 - Contents(a)(1) The language of the indictment must be certain as to the title of the prosecution, the name of the court in which the indictment is presented, and the name of the parties.(2) Upon request of the defendant, the state shall file a bill of particulars setting out the act or acts upon which it relies for conviction.(c) The indictment must be direct and certain as regards:(2) The offense or offenses charged;(3) The county in which the offense or offenses were committed; and(4) The particular circumstances of the offense or offenses charged where they are necessary to constitute a complete offense or offenses.Crim.
