Section 14-121-808 - Construction of ditches beyond district limits(a) In case it is necessary to do so in order to obtain a proper outlet for the drainage system or otherwise to perfect the system of improvements, the commissioners may construct ditches or do other work on land beyond the jurisdiction of the county court or which for other reasons cannot be included in the district, so as to secure the object of the improvement.(b) In that event, they shall have the right to condemn a right-of-way for that drain or other construction.(c) The proceedings for the right-of-way shall be the same that are now provided by law for the condemnation of the rights-of-way for railroads, telegraphs, and telephones.(d) The ditch or drain beyond the limits of the districts shall be the property of the district, and no person, corporation, or other drainage district not assessed shall have the right to dig any lateral drain connecting therewith without paying compensation to be fixed by the circuit court.Acts 1909, No. 279, § 21, p. 829; 1913, No. 177, § 4; C. & M.
