Rule 26 - SLIDING-SCALE FEE SCHEDULE FOR GLOBAL POSITIONING SYSTEMSee TEX. CODE CRIM. PRO. ANN. art. 17.49.
26.1. If, upon consent of the victim to wearing a global positioning monitoring system receptor device, a judicial officer determines that the likelihood of the defendant's participation in a global positioning monitoring system program described by TEX. CODE CRIM. PROC. ANN. art. 17.49 (Vernon 2009) will deter the defendant from seeking to kill, physically injure, stalk, or otherwise threaten the alleged victim, the judicial officer shall determine if the defendant is financially able to pay the costs of the receptor device, and the global positioning monitoring systems transmitter or similar device. If the judicial officer determines that the defendant is indigent, the judicial officer shall require the defendant to pay costs of the electronic receptor device and transmitter according to the following sliding scale: Net Annual Income (from Sliding Scale Worksheet) | Percent of Total Fee per Service |
