Rule 1306 - Award - Delay Damages(a) Arbitrators may consider the subject of damages for delay pursuant to Pa.R.C.P. 238 after a decision had been reached on the merits and has been entered on the award form.(b) After the amount of the award has been so entered, the board shall make a determination as to damages for delay in accordance with Pa.R.C.P. 238 by accepting a sealed envelope containing a stipulation setting forth whether an offer was made in writing and if so, the amount as well as the date of the offer.(c) If damages for delay under Pa.R.C.P. 238 are awarded, the amount thereof shall be added to the principal amount awarded, but shall be separately stated on the award.Amended effective 1/1/2020; amended effective 7/1/2023.
