A. Any person, including a judge, may, following notice and opportunity to be heard, be cited for contempt for: (1) Failure to obey a Commission order, failure to follow a Commission rule, or obstruction of any lawful process of the Commission; and/or(2) Actions which affect the safety or decorum of Commission proceedings.B. If the alleged contempt occurs during a Commission hearing, a presiding officer shall hold a separate hearing before the same Commissioners regarding the alleged contempt. If the alleged contempt does not occur during a Commission hearing, then a separate hearing before a quorum of the Commission shall be held.C. The presiding officer for all contempt hearings shall be a district judge.D. Upon a finding that contempt has occurred, the Commission may make findings of fact, conclusions of law, and recommendations for sanctions, which shall be filed along with the record of the proceeding, with the Supreme Court.N.M.
