Rule 17.46 - 17.49 - Survey of Cases Under Advisement17.46 Twice a year, all circuit court judges, associate circuit court judges, commissioners, and senior judges shall complete and submit a survey of cases under advisement 90 days or more. The surveys shall be completed on the form approved by this Court and distributed by the Office of State Courts Administrator. Judges and commissioners shall submit the surveys to the Office of State Courts Administrator on or before July 31 for cases under advisement 90 days or more as of June 30 and on or before January 31 for cases under advisement 90 days or more as of December 31. Judges or commissioners who do not have any cases under advisement 90 days or more still must complete and submit a survey form so indicating by the specified due dates. Judges and commissioners still must report cases that have been under advisement 90 days or more as of June 30 or December 31 but are resolved prior to the survey's specified due date. Judges and commissioners shall continue to report cases that previously have been reported on a survey form but remain under advisement during subsequent reporting periods. 17.47 For purposes of this Court Operating Rule, a case is under advisement if all matters in the case have been submitted for judicial determination; a motion, hearing, or other matter has been deemed submitted for the court's determination; a rule or statute requires the court's ruling on a motion or other pleading by a specified date; or a case is otherwise ready for the court's determination.17.48 The Office of State Courts Administrator shall report judges and commissioners who fail to timely file a survey in compliance with this Court Operating Rule to the appropriate disciplinary authority. 17.49 The surveys of cases under advisement are confidential judicial records. The Office of State Courts Administrator shall provide each presiding judge with all surveys submitted by the circuit's judges and commissioners as well as the circuit's aggregate survey results. The Office of State Courts Administrator shall provide the aggregate statewide survey results to the clerk of this Court and the Commission on Retirement, Removal and Discipline. The Office of State Courts Administrator shall provide any surveys identifying one or more cases under advisement 90 days or more to the appropriate disciplinary authority.Mo. Sup. Ct. Op.
